Interpretation 

In these conditions the following words have the following meanings:
 
"Contract" means a contract which incorporates these conditions and made between the Customer and the Seller for the sale of goods;
 
"Customer" means the person, firm, company or other organisation buying the Goods;
 
"Deposit" means any advance payment required by the Seller in relation to the Goods which is to be held as security by the Seller;
 
"Force Majeure" means any event outside a party’s reasonable control including but not limited to acts of God, war, flood, fire, labour disputes, strikes, sub-contractors, lock-outs, riots, civil commotion, malicious damage, explosion, terrorism, governmental actions and any other similar events;
 
"Goods" means any awning or any accessories specified in a Contract which are bought by the Customer;
 
"Liability" means liability for any and all damages, claims, proceedings, actions, awards, expenses, costs and any other losses and/or liabilities;
 
"Products" means the products sold to the Customer by the Seller;
 
"Seller" means Duncan’s Caravan & Camping, having a place of business at Wishaw Road, Waterloo, Wishaw ML2 8ES and, from the first Thursday in February each year, at the Scottish Caravan Show, Scottish Exhibition and Conference Centre, Glasgow, and will include its employees, servants, agents and/or duly authorised representatives;
 

Basis of Contract

Nothing in this Contract shall exclude or limit any statutory rights of the Customer which may not be excluded or limited due to the Customer acting as a consumer. Where the Customer is acting as a consumer any provision which is marked with an asterisk (*) may, subject to determination by the Courts, have no force or effect. For further information about your statutory rights contact your local authority Trading Standards Department or Citizens Advice Bureau. 

Payment

 The amount of any reservation fee shall be as quoted to the Customer.

 The Customer shall pay the monies for any Goods and/or any other sums payable under the contract to the Seller at the time and in the manner agreed. The Seller’s prices are, unless otherwise stated, inclusive of any applicable VAT.

Payment by the Customer on time under the Contract is an essential condition of the Contract. Payment shall not be deemed to be made until the Seller has received either cash or cleared funds in respect of the full amount outstanding.

 *The Customer shall pay all sums due to the Seller under this Contact without any set-off, deduction, counterclaim and/or withholding of monies.

Risk

Risk in the Goods or Products will pass immediately to the Customer when they leave the physical possession or control of the Seller

Delivery, Collection and Services

It is the responsibility of the Customer to collect the Goods from the Seller. Prior to the Purchaser removing the Goods from the Seller’s premises, the Purchaser shall have the opportunity to examine the Goods and, following such an examination, upon removing the Goods from the Seller’s premises the Customer shall be deemed to have accepted the Goods as being of satisfactory quality.

If the Goods are rejected by the Customer, it is the Customer’s responsibility to return the rejected Goods.
 

Rectifying Defects

The Seller will supply Goods which are in conformity with the contract. However, should any defect occur with the Goods within a reasonable period after collection, the Customer should contact the Seller in writing at Duncan’s Caravan & Camping, Wishaw Road, Waterloo, Wishaw ML2 8ES.

The Seller will be given the opportunity to inspect any Goods which the Customer considers to be defective. Thereafter, the Seller will be given an opportunity to rectify, repair or replace the defective Goods.

In the event of a dispute between the Seller and the Customer over whether the Goods are effective or whether the Goods are of satisfactory quality or fit for purpose, the matter will be referred in the first instance to a mediator appointed by the National Caravan Council Limited, Catherine House, Victoria Road, Aldershot , Hampshire GU11 1SS.
 

Limitations Of Liability

 *All warranties, representations, terms, conditions and duties implied by law relating to fitness, quality and/or adequacy are excluded to the fullest extent permitted by law. 

*If the Seller is found to be liable in respect of any loss or damage to the Customer’s property the extent of the Seller’s Liability will be limited to the retail cost of replacement of the damaged property.

Any defective Goods must be returned to the Seller for inspection if requested by the Seller before the Seller will have any liability for any defective Goods. 

The Seller shall have no liability for damage, loss, liability, claims, costs or expenses caused or contributed to by the Customer’s continued use of defective Goods after a defect has become apparent or suspected or should reasonably have become apparent to the Customer. 

The Customer shall give the Seller a reasonable opportunity to remedy any matter for which the Seller is liable before the Customer incurs any costs and/or expenses in remedying the matter itself. If the Customer does not do so the Seller shall have no liability to the Customer. 
 

Cancellation Rights for Distance or Off-Premises Contracts

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 the Customer may cancel a distance or off-premises contract at any time within the cancellation period. The cancellation period ends at the end of 14 days after the day on which the Goods came into the physical possession of the Customer. 

If the value of the Goods is diminished by any amount as a result of handling of the Goods by the Customer beyond what is necessary to establish the nature, characteristics and functioning of the goods, the Seller may recover that amount from the Customer, up to the purchase price. 

It is the Customer’s responsibility to return the goods to the Seller within 14 days of the Customer informing the Seller that they are exercising their right to cancel. The Customer must bear the costs of returning the goods. 

The right to cancel does not apply in relation to goods purchased which have been tailor-made for the Customer or altered at the Customer’s request. 

A refund will be provided, subject to any deduction for diminution of the value of the Goods as a result of handling of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods. Refunds will be given by the same method as the original payment was made. In the case of debit/credit card purchases, back to the same card. This does not affect the Customer’s statutory rights to claim a refund, replacement, repair or reduction in price where the Goods are faulty or not as described. 
 

General

The Seller shall have no liability to the Customer for any delay and/or non-performance of a Contract to the extent that such delay is due to any Force Majeure events. If the Seller is affected by any such event then time for performance shall be extended for a period equal to the period that such event or events delayed such performance.

This Contact is governed by and interpreted in accordance with the law of Scotland and the Scottish Courts shall have exclusive jurisdiction.

Distance Selling Regulations

This gives protection to consumers who shop by phone, mail order, via the Internet or digital TV. The protection includes:

  • The right to receive clear information about goods and services before deciding to buy
  • Confirmation of this information in writing
  • A cooling off period of seven working days in which the consumer can withdraw from the contract
  • Protection from credit card fraud

The cooling off period does NOT apply to products customised to the buyers specification. Any products ordered that are personalised or customised in any way may not be returned. For more details on returns, please see our Delivery & Returns page.

Notice of Cancelation Rights for Distance or Off-Premises Contracts

Online Payment Security

Rest assured your internet transaction is completely safe and secure. We now offer three online checkout procedures for your convenience, PayPal or RBS Worldpay, and now Google Checkout. Each method offers up to date payment processing facilites and security. The safety of your payment is our first priority. Your card details are not disclosed to us at any point, they are taken and processed by PayPal, RBS Worldpay, or Google Checkout secure servers. We will never share any of your submitted information with any third parties whatsoever.

Payment By Phone

We accept most credit and debit cards. We will ask you several security questions about your card so please have your card in front of you when calling to place your order. Do not include any credit or debit card details in any emails to our sales department. Details will be taken over the phone. Please call 01698 374224 as soon as possible and your payment will be processed. It is only possible to send goods to the registered card holders address when paying over the phone.

Dispatch Times

Our average dispatch time of items in stock (excluding awnings) is 24 hours, however please allow up to 3 working days of receipt of full payment for your goods to be dispatched. Your goods will be sent by courier or Royal Mail depending on the size, weight, and value of your order, and should be delivered within 48 hours of dispatch. We do not deliver to any locations outside of the mainland United Kingdom, sorry. Goods ordered on a Friday or over the weekend should be processed on the following Monday, goods can be delivered on a Saturday at an extra charge, please email for a quote.

Postage & Packaging

We charge a flat rate of £6.95 per order for all goods shipped within the mainland United Kingdom.

Receipt Of Goods

All goods must be signed for. Please check the condition of the goods before signing the carriers receipt. Any damages or shortages must be noted at time of receipt. Any damages or shortages must be notified to Duncans Caravan & Camping within 24 hours of delivery. We will use two means of shipping depending on the item, smaller lighter items will be dispatched by Royal Mail first class recorded delivery. Larger, heavier items will be sent via our carriers.

All items will require a signature on delivery. If our couriers attempt delivery and there is no one in then they will return the next day. If there is no one in again they will leave you a card with contact details for you to arrange to collect the goods from their depot.

Receipt Of Awnings

Please give an address where there will be someone in. Due to their size and weight awnings are dispatched using another carrier, and they will not re-attempt delivery without an additional charge. All goods must be signed for, please check the condition of the goods before signing the carriers receipt. Any damages or shortages must be noted at time of receipt. Any damages or shortages must be notified to Duncans Caravan & Camping within 24 hours of delivery.

Returning An Order

Any goods can be returned to us within 7 days of purchase provided the goods are still unused, in the original packaging and any sealing straps unbroken. Unfortunately, we cannot accept any tents or awnings returned which have already been pitched. If you wish to return goods simply send the item back to the address on our contact us page with a note giving your name, address, and telephone number. Once the goods have been inspected one of our sales department will contact you about your refund. We will refund your original purchase excluding P&P. Return postage and returning your items is the responsibility of the buyer.

Faulty Goods

If you discover a fault with your goods please contact our sales department to discuss the problem. If the fault cannot be rectified with the supply of parts then the faulty component must be returned for examination. We reserve the right to examine and repair faulty goods where appropriate.

The product weights, sizes, plans and colours on this web site are given as an indication and are only approximate. Due to the continuous product development carried out by our suppliers, Duncan Caravan & Camping reserve the right to alter specifications and prices at anytime and without prior warning. E & OE.
